PHP Rescue
Terms of Service
1. Scope
These terms apply to all services provided by Tecnosign Labs OÜ (17038892), Ruunaoja tn 3, 11415 Tallinn, Estonia — in particular PHP security checks, patching, malware removal and legacy PHP migration. Terms of the customer that conflict with these do not apply unless we agree in writing.
2. How a contract is formed
Submitting the website form is a request, not an order. A contract is formed only when we send a written confirmation with a fixed price and you accept it.
3. Prices and payment
Prices on this website are fixed prices in euro, excluding VAT where VAT does not apply under the reverse-charge rule for business customers outside Estonia. Payment is due within 14 days of the invoice date. We may ask for advance payment from first-time customers.
4. Customer duties
Before we begin, the customer must provide:
- A current, tested backup of the website and database
- Access, or a person able to run commands on the server
- Written approval before any change is made to a live system
- A short maintenance window in which changes are acceptable
4a. If no backup exists
If the customer cannot provide a backup, we may refuse the job or perform it only against a written waiver of backup-related claims. We do not create backups from untrusted, possibly compromised systems as a substitute.
5. What is not included
Unless expressly agreed, our work does not include: recovery of deleted data, repair of damage caused by a prior compromise, rewriting of incompatible plugins or custom code, search-engine or blacklist removal, or any warranty that a third-party website will function after a version change.
6. Execution and testing
We test changes on a copy where the technical setup allows it. The customer is responsible for final functional acceptance of their own application. We document every command we run and hand over that record with the job.
7. Liability
We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For simple negligence we are liable only for breach of a material contractual duty, and limited to the foreseeable damage typical for this type of contract. In all other cases our liability for simple negligence is limited to the amount of the fee paid for the specific job concerned. This limitation does not apply where liability is mandatory by law.
8. If we cannot fix it
If we cannot deliver the agreed result, the customer pays nothing for that job and keeps the written report. Amounts already paid for that job are refunded.
9. End-of-life software
For PHP versions that no longer receive official security updates, no complete remedy exists. Where we apply third-party backports or mitigations, we state clearly in writing that this is a partial measure and not equivalent to a supported version.
10. Confidentiality
We treat all customer systems, data and credentials as confidential, use them only for the agreed job, and delete credentials after the job ends unless the customer asks us to keep them for ongoing support.
11. Applicable law
The law of the Republic of Estonia applies. For consumers this choice of law does not remove the protection of mandatory rules of the country where the consumer has their habitual residence.
12. Severability
If a clause of these terms is invalid, the rest remains valid and the invalid clause is replaced by the rule that comes closest to its economic purpose.
